Terms and Conditions Art Exhibition
These conditions apply to the exhibition of Works managed by the Exhibition Organisers at Bydesign Collective, For the purpose of these Terms and Conditions 'BDC,' 'Exhibition Organisers,' "we," "us," or "our" refer to Bydesign Collective. 'You,' refers to exhibiting artists and 'Work, Work(s)' refer to any art work exhibited. 'Exhibition' refers to the 'Forging Paths of Passion' Retail and Art exhibition hosted at 58 Oxford Street, London.
WHO CAN APPLY:
1.1.The application process is open to women artists over 18 years of age. Artists, photographers, printmakers, ceramicists and sculptors producing original work at any level in their careers may apply. A third party (e.g. agent or other representatives) may apply on behalf of the artist, but the third party must confirm that they have the full permission of the artist to display their work. If you are so authorised, You agree to be bound by these Terms and assume the liabilities set out in these Terms.
THE SPACE
2.1 Single or multiple spaces in 2mx2m sections can be booked. There are a total of 7, 2mx2m spaces available.
2.2. For a single space, all individual artwork will be required to fit within the 2mx2m space with a margin of 25 cm on the top and bottom of the display. If you are booking a larger space a 25cm margin at the top and bottom still applies but maximum size of artwork will vary proportionately. Number of works displayed by each artist is up to their discretion as long as the required clear space of 25cm is maintained.
THE WORK
3.1.The Exhibition is open to 2 dimensional and 3 dimensional Original Works, glass work, ceramics and sculptures in clay and other materials. Limited edition high quality photographic prints by photographers, as well as any art originally produced as print using printmaking techniques, will be welcome.
3.2.High quality reproduction prints of artwork will be accepted alongside original work however at least 60% of the display must constitute original art. 3.3.Original works in all mediums are welcome, including but not limited to: painting, drawing, mixed media, photography, print making and textile.
3.4.The Work must be available for the full duration of the exhibition
3.5.All Work must be for sale.
3.6.All proposed work would need to be submitted to the Exhibition Organisers prior to the exhibition for general approval.
3.7.The Exhibition Organisers reserves the right to override the layout, placement, and hanging of artwork within the exhibition space if deemed unsuitable to the overall look of the exhibition.
INADMISSIBLE WORK
4.1.The following types of work are inadmissible:
4.2.Work(s) that are over the specified size limit
4.3.Work(s) of an explicit nature not suitable for children as this is a family friendly event
4.4.Work(s) not available to buy.
APPLICATION PROCESS AND BOOKINGS
5.1.Artists must apply to take part using the online application form. On receipt of your application we will send you pricing information. If your application is successful we will send you booking and payment details. Once accepted, you will be required to make payment in full via bank transfer within 7 days of receiving our acceptance email. Please note once acceptances have been sent spaces will be allocated on a first come first serve bases of receiving payment from applicants. Quick payment after receiving acceptance is advised to ensure booking.
5.2.All communication will be by email.
5.3.Choice of space location may be available with early bookings and will be allocated on a first come first serve basis.
PHOTOGRAPHY OF WORK
6.1.We will require high resolution clear images of your work 6-8 weeks prior to the exhibition for promotional purposes. We may choose to produce a catalogue of the exhibition. If images are not received in time or are not usable, we will not be able to include them
6.2.Work must be photographed unframed.
6.3.The images you submit will be the final images used for promotion — please make sure they are accurate and high-quality photos.
6.4.Submission of low-quality, incorrectly taken photographs may lead to the Work being excluded
CURATION OF THE EXHIBITION
7.1.We will be working with a small group of experienced artists and advisors who will help curate the exhibition
7.2.We endeavour to give each artist as much autonomy as possible in choosing, displaying and presenting their work however from time to time it may be deemed necessary to specify requirements in order to improve the overall presentation and essence of the exhibition.
7.3.As we are a collective run by artists for artists, we hope to work in close collaboration with participating artists and would hope to draw on their help from time to time as required.
FRAMING, GLAZING AND PRESENTATION
8.1.If your work is framed please make sure frames are in good condition and sturdy enough to withstand hanging fixtures.
8.2.Metal, glass and Perspex clip frames are not acceptable. Glazed Works with unprotected glass edges are inadmissible.
8.3.Framing of works is the responsibility of the artist and must be carried out prior to the exhibition.
8.5.All works must be exhibition-ready. Suitable hanging fixtures should be supplied, sufficient to carry the weight of the work.
7.6.Format for labelling, artist bios and promotional material will be provided. You will be required to follow the agreed format in order to maintain the look of the exhibition.
HANGING OF WORK(S)
9.1 All work will need to be hung by artists on Monday 27 Nov, times to be confirmed sooner to the exhibition. If you are unable to hang your own work please inform the Exhibition Organisers 2 weeks before the exhibition who will arrange for it to be done at a small charge to be arranged directly with the hanging team.
9.2 Artists are responsible for insuring their own work. All Work(s) accepted for the Exhibition will be displayed entirely at the artists' risk and organisers and the Exhibition staff will not accept liability for loss or damage occurring during the Exhibition.
TAKEDOWN OF WORKS AND DELIVERY OF SOLD WORKS
10.1.All Work(s) will need to be taken down on 3 December after 6pm.
10.2.Delivery of any sold work is the responsibility of the artist and must be arranged with the purchasing customer directly. Bydesign Collective and the Exhibition team will not be responsible for any storage or delivery of displayed work.
ADVERTISING AND PROMOTION
11.1 You and Us are both responsible for advertising and promoting the Event. All advertising materials used by the businesses are subject to scrutiny by the company and can be requested to be taken down if deemed inappropriate.
11.2 We may, on occasion, take photos and video the Event for promotional and advertising purposes. If you do not wish to be included in any photos or video you must make us specifically aware of this in writing prior to the Event.
PRICING, COMMISSION & SALES
12.1. All Work(s) exhibited must be for sale
12.2.All sales made by artists during the exhibition are commission free if exhibiting artists are handling their own sales transactions
12.3. If you are unable to take your own payment for sold work and would like us to do that on your behalf we can do so for a small handling and transaction fee of 10% of total sales. In which case the price of Work(s) stated must include a 10% handling fee to cover Bydesign Collective's transaction, administrative and packaging cost of sold work. On sale of artwork, sale price minus 10% handling fee will be remitted by bank transfer to artists within 14 days of the end of exhibition.
INTELLECTUAL PROPERTY RIGHTS
13.1 By exhibiting Your Work(s), You confirm that the Work(s) is free and clear of any liens, claims, encumbrances or restrictions, that the use of the Work(s) under these Terms will not infringe upon or violate the rights of any person or entity, and that to the best of Your knowledge and belief the Work(s) has not been exported from any country and shall not be imported into the United Kingdom in violation of any applicable laws or regulations.
13.2 If You do not own all of the rights, title and interest in and to the Work(s), You must expressly inform Bydesign Collective in writing of all relevant details concerning all other third parties rights to the Work(s). You shall indemnify Bydesign Collective against all losses, liabilities, costs and expenses in respect of claims made by third parties alleging partial or total ownership of the Work(s) or any rights in the Work(s), including intellectual property rights.
13.3 Bydesign Collective have the right to copy and/or reproduce the Works and to communicate and/or issue such copies to the public in connection with the exhibition, for advertising the sale of the Works, for educational and public workshops, and for general marketing or promotional purposes, and other related activities, including without limitation the incorporation of images of the Works within promotional and marketing materials, postcards, catalogues, posters, DVDs, on Bydesign Collective websites, on information screens throughout the exhibiting gallery and any media now known or hereafter devised.
LIABILITY
1.41 By submitting Your Work(s), You confirm that the Work(s) is in a condition to withstand normal rigours of handling and display by Bydesign Collective. Whilst we will always do our very best to ensure the safety and security of your work, Bydesign Collective is not liable for any damages to artwork or frames that may occur whilst artwork is in our possession.
14.2 Bydesign Collective undertake no responsibility whatsoever for any loss of, or any damage to, Works entrusted to them, whether arising from fire, default, error, neglect or theft by carriers, packers or other persons and whether in their own employment or not, or otherwise howsoever and all goods are at artist owner’s risk absolutely and Bydesign Collective excludes all liability to the maximum extent permitted by law. THE EXHIBITION VENUE IS USED FOR VARIOUS PURPOSES AND YOU ARE ADVISED TO INSURE YOUR WORKS AGAINST ALL RISKS.
14.3 If You are submitting Work(s) from abroad then taxes may be levied at the port of entry into the UK. You will not list Bydesign Collective as the importer of the Work(s). You agree to indemnify Bydesign Collective for any charges or taxes incurred by it as a result of (1) the importing of the Work(s) for the purposes of display in the Exhibition and (2) for any back taxes due from You to HMRC on or arising from any sale of the Work(s).
14.4.Artists are reminded that it is highly recommended that the exhibiting artists insure with a reputable insurance company their works of art for their market value.
PUBLIC LIABILITY INSURANCE
15.1.Artists are strongly advised to have Public Liability Insurance (third party insurance) cover for a minimum of £1 Million. We will require to be a certificate of such insurance policy before we can make a final booking.
PERSONAL DATA
16.1 Bydesign Collective will hold the personal data supplied by the artist on the submission form, in accordance with the General Data Protection Regulation (GDPR). It will only be used for administering exhibitions, commissions and prizes and will not be transferred to a third party without the consent of the artist, subject to clause 13.2 below.
16.2 Unless expressly written to the contrary, the artist hereby consents to Bydesign Collective providing third parties with his or her contact details where such third parties might be interested in buying, commissioning or licensing the rights in and to, the Works.
REFUSAL, WITHDRAWAL OR DISQUALIFICATION OF WORK
17.1 Bydesign Collective may accept or decline any Work(s) submitted for the Exhibition entirely at its own discretion. Bydesign Collective's decision is final. Bydesign Collectivein no way condones work that might be inappropriate and/or offensive or objectionable to any third party and reserves the right to have such work excluded from exhibition.
17.2 Bydesign Collective reserves the right to deny admission or withdraw a Work(s) from the Exhibition if for any reason the Work(s), or any circumstances surrounding the display of the Work(s), appears to Bydesign Collective to expose it to potential or actual damage to its reputation, risk of legal proceedings or enforcement including, without limitation, the alleged breach of third party intellectual property rights.
17.3 Bydesign Collective reserves the right to disqualify any Work if the artist has failed to adhere to these Terms and Conditions.
CANCELLING YOUR BOOKING
18.1 In the event that you wish to cancel your Booking, Bydesign Collective’s refund policy is as follows:
· 8 weeks or more before set-up day – full refund, if space can be re-sold or you find a replacement artist we approve, within 14 days of cancellation, less 10% admin charge.
· 4-8 weeks before set-up day – 50% refund, if space can be re-sold or you find a replacement artist we approve, within 14 days of cancellation, less 10% admin charge.
· 4 weeks or less before set-up day – no refund can be given
If Bydesign Collective cannot find a replacement for your stall, unfortunately a refund will not be offered.
If you wish to cancel your booking, to do so please inform Us of your cancellation by emailing: info@bydesigncollective.co.uk by providing Us with your name, email address, telephone number, and Booking Number.
18.2 We may ask you why you have chosen to cancel and may use any answers you provide to improve Our services in the future, however please note that you are under no obligation to provide any details if you do not wish to.
